Prosecutions and enforcement

Occupational health officers from the Ministry of Labour Relations and Workplace Safety can enforce and administer occupational health and safety legislation as per The Saskatchewan Employment Act.

Prosecutions will proceed in situations where it has been determined that a failure to comply with occupational health and safety legislation contributed to a serious injury or fatality in the workplace, where non-compliance poses a serious risk of injury or death, or where a persistent or flagrant disregard for the legislation exists.

Section 3-79 of The Saskatchewan Employment Act sets out the maximum penalties that may be imposed when individuals or corporations are found guilty of an offence outlined in the Act.

While the maximum penalty is set by legislation, the actual amount charged to an individual or corporation is determined by the Courts.
